The 2013 OSTP memorandum applied to federal agencies with over $100 million in annual research and development (R&D) expenditures. The memo directed these agencies to develop public access plans to support increased public access to the results of federally funded research.
A 2019 report by the United States Government Accountability Office (GAO) indicated that the memo did not define "agency" and the GAO interpreted this to mean any "cabinet-level department, agency, or subcomponent thereof, including, but not limited to, an office, institute, or center, unless otherwise specified" (GAO-20-81 [PDF – Links to an external source and may not be accessible], p. 51). The GAO accepted "each agency's interpretation regarding whether they were subject to the OSTP memo" (GAO-20-81 [PDF – Links to an external source and may not be accessible], p. 52), and identified 19 agencies, 16 of which also reported requiring the submission of Data Management Plans.
Current public access plans can be found on agencies' websites. Searching for "Public Access Plan" AND "[insert federal agency]" in a web browser will often provide reasonable results to guide finding these plans. Links to several example public access plans are shown below.
The 2022 OSTP memorandum applies to all federal agencies with R&D budgets, and directs agencies to either update existing public access plans or develop new plans.
